General Terms and Conditions

§ 1 Scope

(1) These General Terms and Conditions apply to all orders placed through the online shop “Squish Ritual” at squishritual.com (the “Shop”).

(2) Your contractual partner is the operator of the Shop named in the Legal notice (“we” or “us”).

(3) The Shop is aimed at consumers and businesses. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code, BGB). A business is a natural or legal person or a partnership with legal capacity acting in the exercise of its trade, business or profession (§ 14 BGB).

(4) Deviating terms of the customer are not recognised unless we expressly agree to them.

§ 2 Conclusion of the contract

(1) The presentation of products in the Shop does not constitute a legally binding offer but a non-binding invitation to place an order.

(2) You can add products to the cart and change quantities or remove products there. Via the checkout button you enter the ordering process, where you provide your contact, delivery and payment details. Before submitting the order, all details are displayed again and can be corrected using the browser’s back function or the edit links.

(3) By clicking the “Pay now” / “Complete order” button, you submit a binding offer to purchase the goods in your cart.

(4) Immediately after submitting your order you will receive an order confirmation by email. With this order confirmation we accept your offer and the purchase contract is concluded.

(5) An order can only be placed if all information required for the order is provided.

§ 3 Contract language and storage of the contract text

(1) The contract languages are German and English.

(2) We store the contract text (order data) and send you the order data and a link to these terms by email. You can view and print these terms at any time on this page. If you have created a customer account, you can view your past orders there.

§ 4 Prices and shipping costs

(1) All prices are final prices in euros and include statutory VAT.

(2) Shipping costs may apply in addition. They are shown on the Shipping policy page, in the cart and in the checkout before you complete your order.

(3) For bundles, a struck-through price refers to the sum of the individual prices of the products included.

§ 5 Promotions and discounts

(1) Bundles are combinations of several products at a total price. A bundle is sold as one item.

(2) With the “Buy 3, pay 2” promotion, the cheapest of three participating items purchased together is automatically free of charge. Bundles are excluded. The discount is calculated automatically in the cart or checkout and cannot be combined with other promotions unless expressly stated. If an item from such an order is withdrawn, the discount granted is taken into account proportionally in the refund.

(3) Promotions apply only while they are shown in the Shop.

§ 6 Payment

(1) The available payment methods are shown in the checkout. These may include credit card, PayPal, Klarna, Apple Pay and Google Pay.

(2) The purchase price is due immediately upon conclusion of the contract. When paying via a payment service provider, its terms also apply.

§ 7 Delivery

(1) Delivery is made to the delivery address you provide. Information on delivery areas and delivery times can be found in our Shipping policy.

(2) If an ordered product is unexpectedly unavailable, we will inform you without delay and refund any payments already made without delay.

§ 8 Retention of title

The goods remain our property until paid in full.

§ 9 Right of withdrawal

Consumers have a statutory right of withdrawal. Details can be found in our Withdrawal policy. You can also declare your withdrawal on our Withdraw from contract page.

§ 10 Warranty

(1) The statutory warranty rights apply.

(2) Squishies are soft collectible and anti-stress products. Slight variations in colour, shape or rising speed (“slow rise”) are due to materials and manufacturing and do not constitute a defect as long as they do not impair the intended use. Some product images were edited with AI (background, lighting, presentation); the products themselves are shown true to the original.

(3) Squishies are not edible. Please observe the safety and age information on the respective product page.

(4) Please report obvious transport damage as soon as possible via our contact form. This does not affect your statutory rights; it only helps us assert claims against the carrier.

§ 11 Liability

(1) We are liable without limitation for damage resulting from injury to life, body or health, for intent and gross negligence, and under the German Product Liability Act.

(2) In the event of a slightly negligent breach of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical for the contract.

(3) Otherwise, liability for slight negligence is excluded.

§ 12 Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 13 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive you of the protection of mandatory provisions of the law of the country in which you have your habitual residence.

(2) If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is our place of business.

(3) Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
